How did the Cash Discount Program come about?

In 2010, Congress passed sweeping financial regulations under the Dodd-Frank Act. One of the later additions to this bill was the Durbin Amendment. The Durbin Amendment established the cash discount program and allowed businesses to incentivize and encourage their customers to pay with cash.

How can a cash discount help?

You’re losing money every time you process a credit card transaction, but that doesn’t have to be the case. It’s unfair that you have to pay out of your own pocket to satisfy someone else’s convenience. That’s where a cash discount can help. You can now keep the full percent of your sale by eliminating credit card processing fees with a cash discount.

Is it legal to offer a cash discount?

Cash Discount programs are legal in all 50 states per the Durbin Amendment (part of the 2010 Dodd-Frank Law), which states that businesses are permitted to offer a discount to customers as an incentive for paying with cash.

How do I implement a Cash Discount Program?

You’ll need a credit card terminal programmed to operate within a cash discount program. The terminal comes pre-programmed with cash discount processing. Next, you’ll need to notify your customers of the service fee as well as the cash discount. To accomplish this, you must provide notification at all entrances and points of sale. You will be provided the correct signage. What’s next? Save! Once you’ve successfully implemented your cash discount program, all that’s left for you to do is watch your business’s profits grow!

Should I implement the Cash Discount Program?

The Cash Discount Program can help businesses that are impacted by high processing costs save money by virtually eliminating their monthly card processing fees. Implementing a true cash discount program sounds like a no-brainer, but keep in mind that to do so, you’ll need to list credit prices on the shelves. If you’ve already priced your goods and services to account for the cost of credit cards, implementing a cash discount program is easy. You won’t need to change your shelf or menu pricing and can simply offer a discount on those prices to cash customers.

Will the purchase on my customer’s credit card statement appear as it currently does? Will it list my business's name?

Will my customers be upset by the fee and want to leave?

In fact, surveys have shown that over 80% of respondents stated they wouldn’t think twice about paying 4% Service Fee (only $1.00 on a $25.00 transaction) for the convenience of using their credit card rather than carrying cash. And we all know that fewer and fewer of us are carrying cash these days…and everyone loves the rewards associated with their credit cards. What’s also important to note is that the due to so many digital transactions and service fees for luxuries that have flooded the economy in the last 20 years, most people have become conditioned to service fees as a simple fact of life and have openly accepted this as “normal”.

Can cash discounting be a marketing tool?

For many businesses, the cash discount program when marketed appropriately functions as a tool to attract new customers. Most of the customers like the idea of a discount. A properly implemented cash discount program rewards those customers who want to pay with cash and receive the discount.

Can I offer the Cash Discount Program in my state?

People confuse the cash discount program with a surcharging program. The cash discount program is NOT a surcharge program, and it is available in all States. The Cash Discount Program is a method of implementing an increase in price to all customers while giving a discount to those who pay with cash. Those customers who pay with cash avoid some or if not all (owners discretion) of the price increase. Our technology allows this to happen and keeps you within the guidelines of Visa, Mastercard, and processor regulations.

Is the Cash Discount Program the same thing as a surcharge?

No, the Cash Discount program, while seemingly similar, is actually very different, particularly in the eyes of Visa and MasterCard. As mentioned in the preceding Q&A, the 2013 ruling against the card networks resulted in merchants now being able to implement a surcharge in all but 10 states – California, Colorado, Connecticut, Florida, Kansas, Maine, Massachusetts, New York, Oklahoma, and Texas, plus the U.S. territory of Puerto Rico. Those states claim that a surcharge is not fair to consumers. The Surcharge carries with it several stipulations: Only credit cards may be surcharged – no debit cards Signage must be posted for at least 30 days prior to implementing a surcharge alerting your clientele There is a 4% maximum that can be imposed Surcharging is only allowed in states where the program has not been excluded With the Cash Discount program, these limitations are not in place, as you are not implementing an additional fee for accepting a credit card, you are providing a discount for those who pay with cash. This is a clear distinction.

What are the requirements of the program?

One of the most significant aspects of the program is the fact that businesses must display signs that clearly indicate their participation in the program. These signs must not only be in the entryways of the company but at all point-of-sale locations as well. Additionally, businesses must include all monetary amounts associated with the program on the receipts they provide their customers. If there is a credit card processing fee, companies must display this on the receipt. If a customer receives a discount, companies must show this as well.

Can I just implement the program myself?

When a fee is incorrectly applied to a transaction, an additional fee charged to those consumers using a credit card might be labeled a Surcharge, and that is expressly forbidden by Visa, Mastercard, and the processing provider without taking very specific steps. Additionally, you are forbidden by Visa, Mastercard, and the Processor’s rules to profit on a credit card transaction, which could happen if you accidentally charged more than you were being charged by the processor. The way to avoid this risk is to implement an automated Cash Discount Program that is different than a Surcharge. The Cash Discount Program is a method of implementing an increase in price to all customers while giving a discount to those who pay with cash. Those customers who pay with cash avoid some or if not all (owners discretion) of the price increase.
